Information for clients

Since November 2007 provisions for asset management companies have been in force in Liechtenstein whose purpose is to implement the EU Markets in Financial Instruments Directive (MiFID). Under these provisions we are obliged to make various information publicly available, even if we have already provided that information to our clients when they concluded an agreement with us.   1. Client communication

    Unless client communications are regulated by contract, you may communicate with us at any time in German or English.

    CREA AM will normally communicate with clients by letter or, where necessary, by fax. If you contact us via an electronic channel (e.g. e-mail), CREA AM reserves the right to reply in the same manner. We would draw your attention to the fact that using e-mail presents certain risks regarding confidentiality. As required by the regulatory rules, all telephone calls with CREA AM are recorded and archived.

  3. Investor compensation scheme

    CREA AM is a participating member of the investor compensation scheme operated by the Liechtenstein Einlagensicherungs- und Anlegerentschädigungs-Stiftung SV (Deposit Guarantee and Investor Compensation Foundation PCC, reg. no.     CREA AM itself does not hold financial instruments in safekeeping for clients and never acts as debtor to the client.

  4. Information on the Liechtenstein financial centre
    The Liechtenstein financial centre offer its clients a wide range of financial services. To find out more, visit the Liechtenstein Finance website at (www.finance.li).

  5. Information on financial instruments
    All the information the client needs on the types of financial instruments and the risks associated with them can be found in the "Risks in Securities Trading" brochure of the Liechtenstein Bankers' Association (LBA), which is available for download from the LBA website (www.bankenverband.li).

  6. Handling conflicts of interest

  7. Participation policy
    CREA AM is covered by the term "asset manager" pursuant to Art. 367a item 3 of the
    Liechtenstein Persons and Companies Act (PGR) and is therefore obliged to define its participation policy within the meaning of Art. 367h PGR.   9. Bespoke agreement
    With individual clients CREA AM will conclude separate bespoke written agreements on the client's classification for MiFID purposes, periodic reporting, the client's investment objective and portfolio structure, any applicable benchmarks, the valuation of financial instruments, financial inducements, data protection and the costs for services rendered.   10. Information for clients from Switzerland (pursuant to Art. 6a CISO
    As a Swiss client of CREA Asset Management Trust reg. based in Vaduz, Liechtenstein, for the purposes of this business relationship you will be deemed by your custodian bank to be a "qualified (accredited) investor" pursuant to Art. 10 para. 3 of the Swiss Collective Investment Schemes Act (CISA). This gives you access to collective investment schemes which have not been authorised by the Swiss Financial Market Supervisory Authority (FINMA) and to certain structured products which are not issued by a bank or insurance provider or do not enjoy equivalent protection. As such, in addition to the usual financial products available to private clients, you will have access to a wider range of investments.

    Such products may not necessarily exhibit the same degree of transparency as the collective investment schemes and structured products offered to non-qualified (non-accredited) investors and private clients. Furthermore, the applicable investment policy may not be subject to all the restrictions of the Collective Investment Schemes Act (CISA) and the Collective Investment Schemes Ordinance (CISO). Consequently, the relevant regulations with regard to liquidity, the redemption of fund units or the avoidance of conflicts of interest may be more flexible, offering less protection for investors. Foreign collective investment schemes which are not authorised for distribution to private clients in Switzerland are often not subject to equivalent prudential supervision by a financial regulator, but a more "light touch" regime or no regulatory oversight whatsoever, meaning that they offer investors only limited protection if any. Structured products offered exclusively to professional clients do not have to meet the same collateral requirements as products for private clients.

    CREA Asset Management clients from Switzerland who do not agree to being designated as "qualified (accredited) investors" are kindly asked to inform us of this in writing.

  11. Execution orders
    Orders are generally executed through the client's custodian bank. Detailed information can be found under the heading "Execution of orders" on the CREA AM website (www.crea-group.com).
     
  12. Confidentiality of client data

    CREA AM (including its governing bodies, employees and authorised agents) has a temporally unlimited duty to refrain from disclosing information gained in the course of a business relationship. Under regulatory provisions and statutory notification duties CREA AM may be compelled to disclose client data or other confidential information in electronic or physical format to authorised third parties at home or abroad.
